Terms and Conditions
Welcome to Brunette Home Improvement! These Terms and Conditions (“Terms”) govern your use of our services, and by engaging with us, you agree to comply with and be bound by these Terms. If you have any questions, please contact us directly.
1. Definitions
- “Company” refers to Brunette Home Improvement, its employees, contractors, and agents.
- “Customer” refers to the individual or entity engaging Brunette Home Improvement’s services.
- “Project” refers to the specific work outlined in the agreement or estimate provided to the Customer.
2. Licensing and Compliance Brunette Home Improvement operates in compliance with all applicable federal, state, and local building codes and regulations. Our contractors are fully licensed and insured as required by Michigan law.
3. Scope of Work The scope of work is detailed in the estimate or proposal provided to the Customer. Any additional work or changes outside the agreed scope must be authorized in writing through a change order and may result in additional charges and adjustments to the timeline.
4. Payment Terms
- A deposit is required to secure the Project, as outlined in the agreement.
- Payments are due according to the milestones outlined in the contract.
- Final payment is due upon completion of the Project.
- Late payments are subject to a fee of 1.5% per month on the outstanding balance.
5. Scheduling and Delays Project timelines are estimates and may be affected by unforeseen circumstances, including but not limited to weather, material delays, or permit approvals. Brunette Home Improvement will communicate any anticipated delays and work to minimize disruptions.
6. Materials
- Customers are responsible for material selections and approvals within the timeframe specified.
- If materials become unavailable or are delayed, substitutions will be discussed and require Customer approval.
- Any increase in material costs outside the agreed budget will be the responsibility of the Customer.
7. Warranties and Liability
- The Company offers a 5-year workmanship warranty on completed projects.
- Manufacturer warranties apply to materials used, and the Company is not liable for defects in materials provided by third parties.
- The warranty does not cover damage caused by misuse, neglect, natural disasters, or unauthorized modifications.
- Liability is limited to the cost of the services provided.
8. Customer Responsibilities
- Customers are responsible for preparing the site, including clearing access and protecting personal belongings.
- Customers must provide safe and reasonable access to the Project site for contractors and inspectors.
9. Insurance Brunette Home Improvement maintains general liability insurance and workers’ compensation coverage. Customers are advised to maintain appropriate homeowner’s insurance to cover their property during the Project.
10. Inspection and Approvals The Company will arrange for inspections as required by local building codes. Customers must provide timely approvals for completed work to ensure the Project stays on schedule.
11. Termination of Contract Either party may terminate the agreement under the following conditions:
- Non-payment or breach of contract terms by the Customer.
- Inability of the Company to perform the agreed work due to unforeseen circumstances, with appropriate notice to the Customer.
12. Dispute Resolution Any disputes arising from these Terms or the Project will first be resolved through mediation. If mediation is unsuccessful, the matter will proceed to binding arbitration under Michigan law.
13. Governing Law These Terms and any disputes will be governed by the laws of the State of Michigan.
14. Changes to Terms Brunette Home Improvement reserves the right to update these Terms as needed. Customers will be notified of significant changes before they take effect.
